This Federal Abuse of Our Rights Must End

I believe that currently most federal legislation is enabling the Federal government to take on powers over and above the authority enumerated in the Constitution. Over the next few weeks, I will highlight issues that continue the current trend of vesting inordinate power to the Federal government.  I’ll discuss the obvious issues we typically discuss as federal overreach, such as Obamacare, education, and gun control, but I will also discuss other issues which are, at their heart, Constitutional issues.

If you believe, like I do, that following the clear meaning of the Constitution is the best way to restore our Republic, I need your help to carry that message to the Republican Convention on June 7th and in the fight to unseat Mark Warner in November.

There has been a good deal of attention on the fight between Nevada Rancher Cliven Bundy and the Federal government over the past week. One aspect of the Bundy case highlights something many Americans may have never heard of before; limited first amendment zones. Federal agents determined limited areas around the disputed ranch area where citizens could exercise their first amendment rights. Outside of these areas, the Federal officials determined citizens were not entitled to their first amendment rights. Many people were understandably shocked by this infringement of Constitutional freedoms.

But many people do not realize that the federal government has been trying for years to create additional areas where the Constitution is not fully in affect. So called “Constitution Free Zones” are being used every day by the Department of Homeland Security (DHS) all across the United States to violate privacy rights under the 4th Amendment.

In fact, nearly 2/3 of all Americans, including the vast majority of Virginians, live in the 4th Amendment “Constitutional Free Zone” that extends 100 miles from the border. This Constitutional free zone encompasses every city in Tidewater, Northern Virginia, and in the Richmond metro area.

While DHS has not widely used this power as of yet, they have used it selectivelyIn one case there is a lawsuit pending regarding the seizure of a citizen's laptop on an Amtrak train, taken without a warrant and without probable cause, based solely on these zones.

This flies in the face of the entire purpose of government as outlined in our Declaration of Independence. Our rights are natural and are inherently inborn to every human being. The Constitution is in effect in the entire United States, not just in limited areas determined by the Federal government.

The concept that the Federal government can arbitrarily determine geography where the Constitution applies completely violates the basic principles of natural law that the founders enshrined in our founding documents. The primary responsibility of government is to protect our natural rights. The Constitution doesn’t grant those rights and it certainly doesn’t grant the government the right to limit where the Constitution is in effect.

As your Senator, I will work to eliminate Constitutional free zones everywhere they are in effect and begin working to change the atmosphere in Washington that condones this kind of widespread abuse by the Federal government. With your help, I can fight Mark Warner and be a warrior for our Constitution.
