FW Newsletter: Bureaucratic Tweaks Won't Stop ObamaCare's Death Spiral

A Few Bureaucratic Tweaks Won't Fix ObamaCare's Deeper Problems
- via Reason

On Monday, the Centers for Medicare and Medicaid Services (CMS)—the bureaucratic entity responsible for drawing up many of Obamacare's thousands of pages of regulations—released its latest proposed rules for the law. The new rules are being flagged as a kind of rescue effort intended to bolster the law's exchanges, which are struggling to remain attractive to health insurance companies, but they represent more of the kind of bureaucratic fiddling that is unlikely to have a major impact on the law.

The 294 page rule, oh-so-excitingly billed as the Notice of Benefit and Payment Parameters for 2018, covers a lot of ground, but the headline news were the proposed changes to the law's risk adjustment system. For those who don't speak health wonk, Obamacare's risk adjustment provision is one of the three main mechanisms that the law uses to distribute risk amongst participating insurers, ensuring that no insurer fails under the weight of an unusually sick and expensive customer base. Basically, it requires insurers who end up with an especially healthy group of patients to pay into a system that makes payments out to insurers that end up with unusually sick patients. As a Kaiser Family Foundation report from last month explained, the goal "is to encourage insurers to compete based on the value and efficiency of their plans rather than by attracting healthier enrollees." ObamaCare Premiums Set to Rise, Even for Savvy Shoppers
- via The New York Times

In the last few years, even though premiums in the Affordable Care Act’s health insurance marketplaces were rising, most customers could avoid a big price rise by shopping for a cheaper plan.

Next year, according to a preliminary analysis, that is going to be a lot harder.

Even someone who shopped wisely this year and is willing to switch plans to get the best deal next year is looking at an average premium increase of 11 percent, according to an analysis of rate filings in 18 states and the District of Columbia provided by the McKinsey Center for U.S. Health System Reform. Rank-and-File Republicans Fear Lame-Duck Vote on Pricey Funding Bill
- via The Hill

Rank-and-file House Republicans are dreading voting on a huge spending deal in the lame-duck session — but they may have no choice.

Funding for the federal government dries up at the end of September, forcing Congress to move a stopgap spending bill just weeks before the Nov. 8 presidential election.

Members of the conservative House Freedom Caucus are pushing to extend government funding into early 2017, wary of a massive bipartisan spending deal in the lame-duck. But GOP leaders and House Democrats are already laying the groundwork for a short-term continuing resolution, or CR, that will set up a vote on a catch-all spending bill right before the holidays. Tell the Obama Administration to Stop Using a 1970's Relic to Pursue His Radical Environmental Agenda
- by Kenny Stein

Have you noticed how the price of electronics and appliances like TVs, refrigerators, computers, or cell phones have been continuous declining as a result of technological progress, but the cost of new cars has been increasing? This is not some special quirk of the car market; it is the result of a deliberate policy by the federal government, prodded by radical environmentalists, to increase the cost of purchasing a new car. One of the chief mechanisms for this war on affordability are Corporate Average Fuel Economy (CAFE) mandates, which cost consumers tens of billions of dollars per year. Punishingly high CAFE standards have become a weapon of choice for radical leftists in their efforts to dictate how Americans must live.

In the 1970’s after the Arab oil embargo, the federal government created the mandated fuel efficiency standards for cars known as CAFE standards. These mandates were one of many big government economic interferences imposed during that decade in an effort to be seen to be responding the embargo. Unlike similarly foolish price and supply controls, however, CAFE mandates were never repealed, lingering on as a market-distorting anachronism. In 2009, the new Obama administration found a novel use for these outdated regulations: as a tool for pushing its radical global warming agenda. The Obama administration proceeded to nearly double CAFE mandates, demanding radically higher mandates by 2025. Read more here...

Incentives

Bryan Caplan explains one of the core truths of economics: people respond to incentives. Incentives drive the actions of buyers and sellers in markets, and where government policies go wrong is failing to adequately account for these incentive effects. This analysis shows why government planning fails, while markets succeed. Watch it here...

Climate Change Court Drama: What Does New York's Attorney-General Have to Hide?
- via Reason

New York Attorney-General Eric Schneiderman, as I reported earlier, issued subpoenas to oil giant ExxonMobil last fall demanding that it turn over internal communications regarding what the company knew about the risks of climate change. Schneiderman says that he wants to find out if the oil company fraudulently misled its investors with regard to how man-made climate change would affect its financial prospects.

This effort at legal intimidation then morphed into a group effort with more than a dozen Democratic state attorneys-general who anointed themselves AGs United for Clean Power. The group planned a legal attack not just on ExxonMobil, but also one aimed at many groups or individuals to which the company might donate over the past several decades. The AG from the U.S. Virgin Islands issued a particularly broad and intrusive subpoena to the free market think tank, the Competitive Enterprise Institute, demanding that it turn over "a decade's worth of communications, emails, statements, drafts, and other documents regarding CEI's work on climate change and energy policy, including private donor information. It demands that CEI produce these materials from 20 years ago, from 1997-2007, by April 30, 2016." This attack was clearly meant to intimidate and silence policy players who disagree with the climate consensus. CEI fought back, and the USVI AG backed down. Read more here...

FreedomWorks' Bill of the Month: Transportation Empowerment Act
- by Neil Siefring

FreedomWorks is proud to announce that our Bill of the Month for September 2016 is S.1541, the Transportation Empowerment Act introduced by Sen. Mike Lee (R-Utah), and its House counterpart, H.R. 2716 introduced by Rep. Ron DeSantis (R-Fla). These bills respect the principles of federalism, would cut the federal gas tax, and reduce bureaucracy. Talk about making freedom work.

For too long, much of our nation’s highway transportation infrastructure has been tethered to the whims of the federal government. Our roadways and motorists have been the losers in this arrangement. As U.S. News and World Report explained, “one out of every nine bridges in the country are structurally deficient, nearly one-third of roads are in poor or mediocre condition and more than 43 percent of urban and suburban highways are congested, according to the American Society of Civil Engineers, a nonpartisan lobbying organization which assesses and advocates for U.S. infrastructure.” Read more here...

Keeping You Ahead of the Curve

By Shannon Sands, Publisher, Dent Research

Since 1894, the First Monday of September has been dedicated to the achievements of American workers. We celebrate the contributions workers have made to the strength, prosperity, and well-being of our country.

As we head into our long weekend – the unofficial end of summer and what we here in Ocean City, MD affectionately deem the start of the "second season" – I'd like for you to join me in thanking all the people on the Dent Research team for all they do behind the scenes. Day in and day out, these men and women work hard to help you stay ahead of the curve, navigate these irrational markets, and grow your investment account balances.

From the editorial team – Teresa, Chris, Jen, Allison, Danny, Ben, Jocelyn and Charles – to the marketing team – Megan, Amanda G., Kelly, Jennifer, and Amanda K. – to the support teams – Bo, Kerri, Danny, KJ, Mary, Ana, Monique and Dave – to our customer experience team – Brandt, Jacquie, Franklin, Ian and Brittany – to the Editors themselves – Harry, Rodney, Adam, Charles, John, Lance and Ben…

Each and every one of them dedicates their days, and often their nights, to helping you. So to all of them, on behalf of all of us: Thank you!

And thank you to YOU too, dear reader.

Without you, we couldn't do what we love to do.

Before you enjoy your Labor Day Weekend, here's a quick look at this week's events here at Dent Research…

On Monday, August 29, Charles sent Boom & Bust subscribers their weekly 5 Day Forecast with a "we said it first" note.

In last week's Barron's, Vito Racanelli wrote about the potentially large flood of cash rushing into real estate investment trusts (REITs) due to index changes being made by Standard & Poor's, of S&P 500 fame, and Morgan Stanley Capital International (MSCI).

As of August 31, REITs will get their own sector rather than being lumped in with the financial sector. So every money manager that indexes to S&P or MSCI will need to carve out room in their portfolio for REITs or risk being underweighted the sector (this is called "tracking error" in finance-speak).

Given the current amount of underweighting, that means as much as $150 billion in capital could be sloshing into REITs.

But this wasn't news to us. Charles was writing about it as early as this past April in Economy & Markets, and Rodney and he wrote about it extensively in Peak Income.

And that's one of the things we strive to do: to keep you ahead of the curve like this.

It's also why we're reducing the price of a seat at our October Irrational Economic Summit from $895 to just $195, for this weekend only. Take advantage of this 78% discount here. The team of great minds we've assembled for you this year includes the Honorary David Walker, Dr. Lacy Hunt, Howard Lindzon and George Gilder!

On Tuesday, August 30, Adam gave Cycle 9 Alert subscribers an update on the biotech sector after issuing a bullish recommendation on XBI the previous week. He wrote:

The timing of my recommendation was hugely ironic. I mentioned the tweet Hillary Clinton sent last September, in which she promised to tackle the pharmaceutical industry's "price gouging" practices. Lo and behold, she took to social media again last Wednesday – the very day after my bullish biotech recommendation – calling Mylan's (MYL) pricing of EpiPen "outrageous." Headline-reading investors reacted quickly with selling, sending healthcare (XLV) stocks down 1.6% on the day. Biotech stocks fared worse, losing 4.3% by the day's end.

But, they're holding onto the trade for at least another month! That's because Adam doesn't let the headlines – or emotion – dictate his investing strategy. Instead, he trusts the system he's developed – and that has proved itself time and time again since 2012.

As he said: "Investing success doesn't come to the smartest investor in the room. Rather, it comes to the investor with the strongest discipline."

On Wednesday, August 31, Harry release the September issue of Boom & Bust to subscribers, giving them an exclusive first look at the Bubble Model he has developed… a model that is the first of its kind.

Every time we have a major collapse in stocks, experts declare it a "black swan event." That, or they say it was totally unpredictable. Harry doesn't believe this for a second. Major booms and busts are, in fact, very predictable. And now he has a model to prove it.

On Thursday, September 1, Charles wrote to you about why it's so important that you DON'T trust your gut… that, instead, you trust the system. He related the story of Ray Dalio…

In August of 1971, Ray Dalio – now one of the most respected hedge fund billionaires on Wall Street – was a lowly clerk working on the Street. By coincidence, Dalio was starting his career during one of history's critical turning points. President Nixon had just taken the dollar off of the gold standard.

Dalio's gut told him the market would crash the next day. Instead, it rallied. Hard! The Dow finished the day almost 4% higher.

It's not much of a stretch to compare then to now... Back then – as now – you had central banks meddling in the markets. And back then – as now – you had unexpected results.

Dalio learned a lesson from his experience. He realized that the market has a knack for doing what you least expect it to do… and he reached the conclusion that, rather than trying to guess what happens next, the better course was to simply build a portfolio that would perform well in any environment… no matter what happened. So he launched his All Weather portfolio, and the rest is history.

Now, we're not necessarily recommending you run out and invest with Dalio. Even if you wanted to, you wouldn't meet the minimums. You'd need $5 billion in investable assets to get in the door.

But we do recommend that you take a few plays out of his playbook… Read the article for full details.

And finally, on Friday, September 2, John explained how his Forensic Investor subscribers were recently able to bank a 30% gain by selling short GIII Apparel. John had six tip-offs that the stock was in trouble. You can read about them here.

Happy Labor Day,

Killing Us with Healthcare

By Rodney Johnson, Senior Editor, Economy & Markets

EditorI've never heard anyone brag about what they spend for a medical procedure. Healthcare isn't like housing or transportation. People are proud to shell out big bucks for a big house, and many drivers can't wait to show off their expensive set of wheels.

But when it comes to healthcare, we're only smiling when we save money, not spend it, which makes the current trend so much more difficult.

While government officials point to slower price increases and bray on about bending the healthcare cost curve, everyday people are watching more of their hard-earned dollars fly out the door to pay for care. Even though overall costs might be rising at a slower pace, the amount consumers have to pay is shooting to the moon.

And the pain doesn't stop at the door to retirement. As the healthcare monster devours more dollars, we have less money to spend where we want, which adds to the misery in our economy, and will eventually add to a nasty financial setback.

Middle-income households now spend more on healthcare than any other cost outside of shelter. This part of their budget jumped more than 3% from 1984 to 2014, and now eats up 8.9% of their funds.

Most of the increase occurred in the last 10 years, as healthcare spending rose 25% from 2007 to 2014. As these families spent more on doctors and prescriptions, they spent less on food, housing, clothing, and transportation.

Keep in mind that this calculation ends just as the ironically named Affordable Care Act went into action. Since 2014 things have gotten much worse, not better.

Adam O'Dell's "GREEN ZONE"

Over the last four years, this small but powerful window of opportunity has delivered gains as high as 116%, 124%, 140%, 191%, 201%, 316% and 336%... ALL in less than 90 days! Click here now to read more on how Adam's been crushing the S&P for the last five years and how you can get his next GO signal immediately.

Consumers who purchase insurance on the healthcare exchanges know about rising prices all too well. Premiums have increased by double digits every year for most buyers, and in 2017 prices will shoot higher by almost 30%.

In just a few short years, premium prices are up 50%, and that's just for the privilege of buying insurance. Sure, there are subsidies out there for almost 90% of buyers, but that covers just the premium cost. Once you have insurance, there's the small matter of the deductible.

Insurers have reconfigured policies to include higher deductibles to keep premium prices lower than they would have been. That's nice in theory, but with premiums up by double digits each year, tacking several thousand dollars onto the deductible just adds insult to injury.

Deductibles of $5,000 and $6,850, on top of $1,000-per-month premiums, are common. This is also where workers who get their insurance through their employers are feeling the heat.

Firms still pay roughly 80% of insurance premiums for employees, but the plans are less generous, requiring more deductible payments. The effect, while not as pronounced, is the same. Consumers have less cash to spend on what they want.

For retirees, the math gets more complicated.

The government deducts Medicare Part B payments from Social Security checks. This year, the price of Medicare Part B is expected to climb more than 20%, or about $27 per month. But inflation has remained tame, so the Social Security Cost-of-Living Adjustment (COLA) could be as small as 0.2%, or even flat. For those receiving the average benefit of $1,335 per month, this equates to less than $3 per month. The increase in Medicare Part B will eat up all of that gain and then some.

Recent retirees might get some relief. If they earn less than average income, then the Hold Harmless Act would shield those who retired in the last year from a Medicare cost increase that would reduce their benefits below the prior year's level.

Unfortunately, this only works once, and then the recipients must eat the cost. The price of Medicare Part B jumped 16.1% last year, so those who were able to avoid that price hike now have to pony up.

To make it even more of a puzzle, if the COLA ends up at 0%, then the Hold Harmless Act doesn't apply, and all Social Security recipients will get hit with the full cost increase, thereby lowering their incomes.

The end result is that most everyone in America is paying significantly more for healthcare, either through premiums, deductibles, or a combination of the two. This leaves us with less money to spend on what we want. It's harder for young families to afford having children or buying homes, while retirees can't spend as much on maintaining their lifestyles. For those in the middle, saving for retirement and education is difficult.

The problem with healthcare is that it doesn't fade with an economic downturn. When our economy resets and financial assets drop, healthcare costs will remain high, eating up more of our falling incomes, and creating a further drag on the economy.

And it doesn't stop with consumers…

The premium subsidies for the health exchanges, and the makeup payments for the Hold Harmless Act, come from somewhere. Or, more to the point, from someone. That lucky person is the U.S. taxpayer, who is on the hook for ever-rising healthcare costs as the government declares bigger sections of the population eligible for assistance.

As equity markets reach new highs and consumer misery plumbs new depths, something's got to give.

Don't be left holding the bag when the markets roll over. Make sure you have enough left in your pocket to pay for your premiums… and your deductible.

Always a Bull or a Bear Somewhere

By Adam O'Dell, CMT, Chief Investment Strategist, Dent Research

EditorLove him or hate him, President Obama made one of the best stock market calls… ever!

On March 3, 2009 he said, "Buying stocks is a potentially good deal."

Just three days later – on March 6 – the S&P 500 bottomed out and has since marched 217% higher. In hindsight, we know his timing was nothing short of incredible!

But buying at the bottom – in real-time (and with real money) – is incredibly difficult to do. Very few investors have the emotional fortitude to buy aggressively when there's blood in the streets and a call for Armageddon in the news cycle. And if you call the bottom too early, you're toast!

That said, bear markets are incredible opportunities... if you have a proven strategy that tells you exactly when it's time to buy.

Well, that's exactly what my Cycle 9 Alert strategy is designed to do.

My Cycle 9 Alert approach plays sector-specific trends because, as I like to say, "There's always a bull market somewhere."

By the same token, "there's always a bear market somewhere," too.

And while you've probably been told that the market is either bullish or bearish – with no in-between – you're limiting your profit opportunities if you're stuck thinking of it that way.

Take the healthcare sector, for instance.

Does Social Security Owe You an Extra $10,224 This Year?

Did you know that roughly $25 billion in Social Security benefits goes unclaimed each and every year? In fact, Americans who filed their Social Security incorrectly may have "missed out" on more than $120,000 in unclaimed benefits last year.

I just put together a presentation to show you how you can collect the Social Security owed to you.

Watch This Free Presentation to Find Out How You Can Claim an Extra $10,224 in Social Security...

Beginning last September, two subsets of the healthcare sector slipped into a bear market, losing more than 20% from their recent highs. And the selling didn't stop at 20%...

The pharmaceuticals sector (XPH) lost a full 43% between September and March. And the closely related biotech sector (XBI) lost 50% in even less time!

Meanwhile, in April, the S&P 500 was sitting just 2% below its all-time high.

Now, I fully realize it seems odd for entire sectors and industry groups to go through full-blown bear markets while, at the same time, the major stock indices are hitting new highs. But this is actually fairly common.

For various reasons, individual sectors can go through periods of dramatic underperformance. We've seen this recently in the energy sector. And before that, a bear market in the metals sector led my Cycle 9 Alert system to a hugely profitable opportunity.

Earlier this year, in January, metal-mining stocks were down a whopping 73% from their highs and nobody wanted to touch these stocks with a 10-foot pole.

But in February, my Cycle 9 Alert system triggered a buy signal on a left-for-dead silver miner from Canada – Pan American Silver Corp. I recommended the trade to my subscribers and two months later we walked away with a cool 225% profit!

Now, this may seem like an unusual result. But in fact, my research shows that some of the very best rally opportunities come from sectors that are crawling their way out of bear market territory.

In fact, the profit-per-trade of these bear market opportunities is three-times stronger!

These opportunities don't come about every day. They're certainly rarer than bull market opportunities (since stocks tend to spend more time rising than falling).

But if you're patient, sector-specific bear market opportunities come about often enough to make some serious coin! Like the 225% I helped Cycle 9 Alert readers make between February and April this year, on Pan American Silver Corp.

And like the 100%-plus profits I'm targeting on our most recent sector-specific bear market opportunity… in a beaten-down niche of the healthcare sector.

For obvious reasons, I can't divulge the full details of this trade (released just last week). But the investment I recommended is still trading within my suggested buy range, so there's still time to get in.

You can access my Cycle 9 Alert system – and this particular trade – by clicking here.

In short, my research shows that you shouldn't discount bear market buying opportunities. And you should stop looking at the market as one giant blob of (over-priced?) stocks.

With my sector-specific Cycle 9 Alert approach, there's always an opportunity somewhere.

To good profits,

Adam O'Dell, CMT
Chief Investment Strategist, Dent Research

FW Newsletter: ObamaCare's Broken Promises Revealed

Support for Common Core Drops to New Low
- via The Washington Examiner

For the first time, support for the Common Core educational standards no longer outdoes opposition.

According to the 2016 Education Next poll released Tuesday, among those who take a stand on the issue, 50 percent of the general public supports Common Core, with 50 percent opposed.

Although fewer Republicans than Democrats support Common Core, Democratic support dropped by 10 percentage points in the past year, while Republican support dropped by 4 points. Read more here...

Rebuilding After Louisiana Floods Will Require Government Permission Slips
- via Reason

After two weeks of devastating flooding in Louisiana that left at least 13 people dead and thousands homeless, residents are starting the arduous task of cleaning up and rebuilding.

President Barack Obama joined the fray on Tuesday, making a visit to some of the hardest hit areas of East Baton Rouge Parish and promising government aid to those affected by the historic flood.

As residents of the area will learn in the coming weeks: that government aid comes with strings attached that could drive up the cost of rebuilding or even prevent people from staying on the same property. Even if that's not the case for others, mandatory government permission slips are required before any substantial work can be done. Read more here...

The Disaster In Louisiana Calls for a Measured Response From Congress
- by Neil Siefring via The Daily Caller

The flooding in Louisiana has been nothing short of tragic. The loss of life, the people displaced, and the damages that have permanently altered the lives of the people of Louisiana in the “worst disaster since Sandy” requires a response from Congress that is measured and fiscally responsible.

There is talk on Capitol Hill of implementing supplemental spending for the disaster in Louisiana that may be included in a continuing resolution — a bill instructing the Treasury Department to keep funding the government at current fiscal year levels – which Congress will likely take up in September. Congress has failed once again to pass the 12 spending bills that fund the government and get them to the president’s desk for his signature before the end of the fiscal year on September 30. Therefore, lawmakers will have to pass a continuing resolution when it gets back in September in order to avoid a federal government shutdown. Read more here...

The Federal Communications Commission Should Take a Selfie
- via Forbes

There are either dozens of federal agencies or hundreds, depending, seemingly, upon the day of the week or whom one asks.

The Federal Communications Commission (FCC ) is not the top dog among regulatory bureaucracies by the number of rules issued–but it’s a contender going by influence.

The FCC merits far closer scrutiny from Congress than it gets, because it wields extraordinary authority over major economic growth engines in today’s economy: telecommunications, the Internet and the information economy generally. By extension, it’s likely to try to wedge itself into influencing such domains as autonomous vehicle communications on land and air, even though Congress hasn’t a passed law giving it such power over emerging frontier sectors. A Conservative Way on Infrastructure
- by Adam Brandon via RedState

It is easy to forget that bad policy ideas aren't limited to one particular political party. Recently, Hillary Clinton proposed $275 billion in infrastructure spending over five years and $225 billion in loan programs through a national infrastructure bank. Not one to be outdone, Donald Trump pledged to double Clinton's proposed spending, saying in an interview with Fox Business, "We need much more money to rebuild our infrastructure."

As it stands now, neither candidate is looking at other ways to address our country's infrastructure by empowering states to prioritize projects based on their needs, without the influence of bureaucrats and special interests. The top-down, federally-driven approach to infrastructure will be preserved. Read more here...

Prices, Information, and Coordination

Donald Boudreaux explains how scarce resources are allocated in a free economy. The price system, where every producer is free to charge what he wants, contains an immense amount of information that tells producers how much to make, and consumers how much to buy. Through millions of transactions every day, coordination happens throughout an entire economy—which is impossible for a central authority to replicate. Watch it here...

Aetna Has Revealed ObamaCare's Many Broken Promises
- via Time

They’re dropping like flies.

The health-insurance giant Aetna has announced it will exit 11 of the 15 health-insurance exchanges where it sells Obamacare plans. Aetna’s announcement comes on the heels of news that UnitedHealthcare, Humana, Blue Cross and Blue Shield of New Mexico, Blue Cross and Blue Shield of Minnesota, and Texas’ Scott and White Health Plan, and 70% of Obamacare’s failed Co-Ops, and other insurers will exit many or all of the exchanges for which they had previously shown such enthusiasm.

The ongoing and nationwide exodus of insurers is just the latest piece of evidence that Obamacare is a failed law built on false promises. Read more here...

Federal Judge Denounces Judicial Deference to Federal Regulatory Agencies
- via Reason

In a landmark 1984 decision known as Chevron U.S.A., Inc. v. Natural Resources Defense Council, the U.S. Supreme Court held that when the federal courts are confronted with an "ambiguous" statute, the default position is for federal judges to defer to the statutory interpretation favored by the federal agency charged with enforcing that statute. "Federal judges—who have no constituency—have a duty to respect legitimate policy choices made by those who do," declared the majority opinion of Justice John Paul Stevens. "While agencies are not directly accountable to the people, the Chief Executive is, and it is entirely appropriate for this political branch of the Government to make such policy choices." In other words, Chevron instructs the courts to tip the scales of justice in favor of federal agencies in cases dealing with questionably worded federal statutes. Lawyers call this approach "Chevron deference."

To say the least, the existence of Chevron deference raises some significant legal questions. For example, don't federal judges have an independent duty "to say what the law is," as Chief Justice John Marshall famously put it in Marbury v. Madison? What's more, doesn't the separation of powers doctrine stand in the way of unelected federal bureaucrats defining the scope of their own authority? Read more here...
